He is presently charged with the murder of a rival gang member, and he claims (as he has claimed in the past) self-defense. You know that Frenzel’s claim of self-defense is false, because there is a key witness in the case who knows both Frenzel and the man he killed, who is not a member of either gang and had no loyalty to either man in the altercation, and who said that Frenzel started the fight and relentlessly pursued the decedent. You located this witness through your own investigation, and the witness told you he would be willing to testify if needed but was moving out of town due to the violence in his neighborhood and gave you his new address and telephone. As the trial draws near, apparently the prosecutor has not discovered this witness, even though he was not very difficult to find. Without this key witness, the case will probably be decided for your assigned client as a self-defense case.
