Although historically the federal courts and the United States Supreme Court have not been instrumental actors in the creation or evaluation of health care reform in the United States, today is a very different story. The Affordable Care Act proposed by Pres. Obama and passed by the Congress has now been upheld by the United States Supreme Court. What constraints currently exist on the policymaking powers of the judicial branch? Should the Supreme Court be charged with determining the validity of healthcare reform legislation passed by Congress and signed by the president?
