Subject: Using ethical lens in the identification and analysis of the possible solutions that can apply to your Case and try offer valid advice on the proper path you can follow.
Problem
The underlying problem encumbering your situation can be traced to legal necessities and ethical issues. One of the ethical issues can be identified with the COO of Seleris Associates Tom Malone in the Industry Analysis Division. Malone informed a client that the Industry Analysis Division had sufficient information concerning Silicon 6. Silicon 6 was used by the company as the code word for its project. This project involved the covert recovery of information regarding a new micro from the company’s competitor. In truth, Malone had maliciously misled his client by informing them a particular worker named Phil Devon was once the company’s employee, and was in a position to share his thoughts willingly. The argument is that the act of economic espionage could have been avoided if it was true that there was going to be an exchange of proprietary information.
In this case, you thought it best to misrepresent yourself to Phil Devon as an International Company representative. You informed Devon that Industry Analysis Division had a view of building a semi conductor processing plant in the United States. Therefore, you saw the need to ensure that Devon was not in a position to breech none compete agreements due to his binding contract with a European Company. The other problem also lay behind the mixed signals passed by the Industry Analysis Division’s client. According to the client, they were willing to accept the illegal information but did not want anything to do with breaking antitrust laws (allegations of price fixing). In addition, the client made advances towards Devon with a view of acquiring the information first hand. This was a situation that called for great care when handling it to avoid any law violations.
Conclusion and Recommendation
Regardless of any attempt or method you will opt to employ when approaching the management, I would advice her to brace herself to deal with criticism and a negative feedback. In addition, it is in my view that she could have to deal immense pressure that will continue to steer how down the path that is conflicting her beliefs and values. It is in my opinion that you should best utilize a push and pull strategy when you proceed to communicate with the senior authorities. This will help as an adequate guide on how you will she will continue with her career at the Industry Analysis Division. However, a dire question arises out of this situation as to whether you should choose to remain at your position and then adhere to the set unethical principles and wait until you are promoted. Therefore, at such a position, she would be well suited to change the manner through which issues are being handled. Or perhaps, you can also choose to cut your losses and quit your job at this point.
Regardless of the associated consequences and the choice you decides to make, there is great need for you to undertake careful hold and navigation of this predicament. My recommendation is that you should consider holding a meeting with Ty Richardson and Tom Malone. This meeting should look to uphold the integrity and ethical values of the company. You can also try to suggest to the two that they try to think of new ways of that can sufficiently finish the company’s silicon 6 project. If at all Richardson and Malone are confronted to reveal the how Industry Analysis Division undertakes its activities by the senior authorities, they will most definitely be left with no other choice but to accept your suggested new ways of finishing the silicon 6 project.
I would also advice you to take advantage of this situation and use it to grow as a manager. You could also assert that the company is also in a position of taking responsibility and should account for its actions. In order to adequately get your point across to Richardson and Malone, you may have to think of using candor. In addition, you also have an option of charging this issue further up the command chain for the rest of the company’s staff to be fully aware of the issue taking place. In support of this argument, the parent company was established by the association of three accounting professors who were deemed to be good at leading at examples. Doing this would be a nurturing process that can steer you to becoming a brilliant leader.
Factors
Confidence: Do not worry too much about this situation. Everybody is bound to make mistakes at any point of their profession. And besides, worrying too much and being anxious will only heighten the situation and cause you to make wrong judgments and consequently end up facing unnecessary consequences.
Morale: You should also exhibit high moral about the situation regardless of the intensity of the risk involved. If you are to appear before the senior authorities, exhibiting high morale on the situation should grant you sufficient confidence to tackle the situation.
Alternative Solution
A good alternative solution can be sending an E-mail to the Seleris Managing Director. In this E-mail, you should start by identifying yourself and the position you hold at Industry Analysis Division. You should open up about the situation and highlight about your incompetent act of misrepresentation. In addition to you owning up to the mistakes you made, you should also come forward and mention the parties that hold a position in breeching the company’s code of conduct and values. Your E-mail should be one that is open ended and attempts to persuade the managing director to consider further discussions with you concerning the matter before taking any legal action.
Comparison of Solutions
I have formulated three possible solutions that you can consider choosing from when attempting to approach her predicament. The first solution revolves around you choosing to resign and therefore dismiss all the pressure clouding your thoughts. This may be a good option but is too far fetched. This will compromise all that you stand for and can also jeopardize your pivotal career moment of being promoted to an authoritative position in the company. The second solution I offered involved you opting to adhere to patience virtue and hope that the situation is going to alleviate in time for your perceived promotion. If promoted, you would definitely hold a better position than you do now and be able handle the situation with minimal worry and anxiety. However, this solution holds the possibility of backfiring and could prove costly if you choose not to act and just hope for the best. The worst could find you sacked and having to deal with a law suit. The third and final solution I offered advices you to take a bold step and invite Richardson and Malone over to a meeting to discuss the matter at hand. In my opinion, this would be the best solution for you to ally as the three of you would be in good positions to find legible solutions to alleviate the issue.
Implementation Plan
Of the above offered solutions, I have concluded that scheduling a meeting with Richardson and Malone as the best option to employ. You should then look to implement this plan by approaching the two and attempting to convince them to attend the meeting between them. You should also consider informing them of the implications involved if such a meeting is not held. These implications involve being sacked and having to deal with legal liabilities such as law suits and damage of reputation. Richardson and Malone will probably have no choice but to accept your request, considering the position they are in. My opinion suggests that the three of you should attempt to develop new ways of finishing the silicon 6 project since the existing one has already been foiled. If this plan is implemented, it will undoubtedly bear positive results.
