Civil Cases and the District Court
First of all court cases are usually of two types and include civil and criminal cases. Fred should use District court to file his claim because this is a civil case. This is because this case involves two individuals who are Fred and Alabama Electrics. It as well involves a definite work related injury that needs compensation which can only be granted by the District courts. It should be noted that Fred went to another district and got injured while working for Alabama Electric. It is stated in the constitution that an employee should be compensated for any form of injury that might be incurred during his work operations and duties for his company (Carp et al, 2010). This means that he will have to look for the nearest court that can be found in Alabama. The district court has authority over both civil and criminal cases found in the state district. Unless otherwise stated in their clauses, Alabama Electric will be forced to appear in court within the stated period. Fred will become plaintiff and Alabama Electric will be the defendants.
It should as well be observed that the District court usually hears, as well as determines civil cases, which involve amounts that are between $50, 000 and $250, 000. It deals with civil cases such as rape, serious assault, fraud, various injuries and burglary. On the other hand, Fred cannot approach the Supreme Court because it deals with civil issues that involve amounts that are over $250, 000. The burden of proof will be beyond a reasonable doubt. Fred will not be able to approach the Supreme Court or Court of appeal because they mostly hear criminal cases and cases on appeal (Carp et al, 2010).
