Trial by jury:
What is the nature of the ‘trial’ that section 80 of the Australian Constitution protects? Why does the right to trial by jury have a different constitutional status at Commonwealth and State levels? Does this matter?
NOTE: This question raises the issue of ‘trial’ definition and the difference between State and Federal levels. It focuses students on the difference between the way the Australian Constitution is interpreted in contrast with the more famous US example.
